The ground rules

These Terms of Service govern your use of Pacterms, operated by ThyVoxa LLC ("Company," "we," "us," or "our").

By using Pacterms, you agree to these terms.

What Pacterms Is

Pacterms is a documentation platform. We help you create simple agreements, track payment status, and build evidence records.

We ARE:

  • A documentation tool
  • A payment tracking system
  • An evidence builder

We are NOT:

  • A law firm (we do not provide legal advice)
  • A payment processor (we do not hold or transmit money)
  • An escrow service (we do not guarantee transactions)
  • A debt collector (we do not enforce agreements)

User Responsibility

You are responsible for:

  • The accuracy of information in your agreements
  • Enforcing your own agreements
  • Following applicable laws
  • Using the platform respectfully

We provide tools. You use them responsibly.

Acceptable Use

Do not use Pacterms for:

  • Illegal activities
  • Fraud or scams
  • Harassment or abuse
  • Anything that violates these Terms

We reserve the right to suspend accounts that violate these rules.

Refund Policy

Pacterms offers a 14-day money-back guarantee on all paid subscriptions.

Eligibility

  • You may request a full refund within 14 days of any subscription charge.
  • The 14-day window resets with each new billing cycle (e.g. on monthly renewal).
  • Only one refund per charge is permitted.

How to Request

  • Self-serve: Settings → Subscription → Cancel & Refund
  • Or email support@pacterms.com within the 14-day window.

Processing Time

  • Refunds are processed immediately upon request.
  • Funds typically appear on your original payment method within 5–7 business days.
  • Your subscription is cancelled immediately upon refund.

After 14 Days

  • Refunds after the window are at Pacterms' sole discretion.
  • You may still cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Non-Refundable Items

  • SMS messages already sent (carrier costs are incurred at send time).
  • Charges already disputed through your bank (those go through Stripe's dispute process).

SMS Messaging Terms

Recipient consent — two-stage model

Pacterms uses a two-stage consent model:

  1. First contact: When a platform user creates an agreement, Pacterms sends ONE transactional notification SMS to the recipient with a secure link to review the agreement. This is permitted because (a) the platform user affirms a pre-existing business relationship, (b) the message is transactional and recipient-specific, and (c) the message includes immediate opt-out instructions.
  2. Continued messaging: Before any further SMS is sent (acceptance confirmation, payment reminders, etc.), the recipient must explicitly opt in by checking a consent checkbox on the agreement review page. Pacterms maintains a verifiable consent log including timestamp, IP address, and the exact consent language shown.

Platform users are responsible for ensuring a legitimate pre-existing business relationship with each recipient. Pacterms reserves the right to suspend accounts found entering recipients without a valid business relationship.

Pacterms is the sole sender of record for all SMS sent through the platform. Recipients can opt out by replying STOP, which ceases all SMS from Pacterms regardless of which platform user initiated the original message.

Message types

Recipients of Pacterms SMS messages may receive:

  • One agreement confirmation link per agreement created
  • Confirmation when an agreement is accepted
  • Payment reminders for outstanding invoices
  • Account security messages (e.g., one-time passcodes)

Acceptable use of SMS

You must not use Pacterms to send unsolicited messages, marketing spam, or any content prohibited by CTIA guidelines, including sexual content, cannabis, firearms, alcohol to minors, or hate speech. Violations result in immediate account termination.

Frequency: Message frequency varies. Typical recipients receive 1–3 messages per agreement.

Message & data rates: Standard rates may apply per your mobile carrier's plan. Pacterms does not charge recipients for SMS.

Opt-out: Reply STOP, UNSUBSCRIBE, CANCEL, QUIT, or END to opt out. Opt-outs are processed immediately.

Opt back in: Reply START or UNSTOP.

SMS is US-only: Messages are sent only to US mobile numbers (+1). Supported carriers include AT&T, T-Mobile, Verizon, and other major US carriers.

Electronic Signatures

Agreements executed on Pacterms are governed by the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. §§ 7001-7006) and the Uniform Electronic Transactions Act (UETA). By using Pacterms, you consent to use electronic signatures and electronic records in place of written signatures and paper documents.
